Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Reality Studio, a service operated by XR Capsules (“XR Capsules,” “we,” “us,” or “our”), including our website at https://xrcapsules.com, mobile applications, software, and related services (collectively, the “Services”).

By creating an account, accessing, or using the Services, you agree to these Terms.

If you do not agree, do not use the Services.

1. Eligibility and Minors

Reality Studio may be used by individuals of different ages where permitted by applicable law.

If you are below the age of legal majority where you live, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf where required.

Where applicable law requires verifiable parental or guardian consent before XR Capsules may collect personal information from a child, the child may use the Services only after such legally required authorization has been obtained.

XR Capsules may limit access by minors where necessary to comply with applicable law.

If you use Reality Studio on behalf of a company, organization, school, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Your Account

You may need an account to use some or all of Reality Studio.

You agree to:

  • Provide accurate account information
  • Keep your authentication credentials secure
  • Not allow unauthorized persons to use your account
  • Notify us if you become aware of unauthorized access

You are responsible for activity occurring through your account unless applicable law provides otherwise.

You may use supported third-party authentication services, such as Google Sign-In. Your use of those services may also be subject to the provider's own terms.

3. Reality Studio

Reality Studio provides tools for capturing, processing, reconstructing, editing, storing, viewing, and sharing spatial and three-dimensional content.

Features may include processing:

  • Images and video
  • Camera tracking information
  • LiDAR and depth data
  • Spatial meshes
  • Scene and object scans
  • Point clouds
  • Gaussian splats
  • Other forms of 3D data

XR Capsules may add, modify, remove, replace, or discontinue features over time.

3D reconstruction is inherently dependent on factors such as capture quality, lighting, motion, device capabilities, scene characteristics, network conditions, and processing algorithms. We do not guarantee that every capture will process successfully or produce a particular level of visual quality or accuracy.

4. User Content

“User Content” means photographs, video, scans, spatial information, files, project information, 3D data, and other content you submit to Reality Studio, as well as content generated directly from those materials.

You Keep Ownership

XR Capsules does not claim ownership of your original User Content.

As between you and XR Capsules, you retain any ownership rights you have in your User Content.

Subject to applicable law and third-party rights, you may also use, download, publish, sell, license, or otherwise exploit generated 3D assets created specifically from your User Content.

XR Capsules retains ownership of its underlying software, algorithms, models, processing systems, interfaces, methods, technology, and generalized improvements.

5. License You Give XR Capsules

You grant XR Capsules a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, copy, process, reproduce, analyze, transform, modify, and create derivative information from your User Content as reasonably necessary to:

  • Provide Reality Studio
  • Process and reconstruct your captures
  • Generate and deliver 3D assets
  • Store and display your projects
  • Provide requested sharing and collaboration features
  • Maintain and secure the Services
  • Diagnose technical problems
  • Develop and test features
  • Improve Reality Studio and related XR Capsules technology

This license also permits XR Capsules, where allowed by applicable law, to use User Content and information derived from User Content to develop, train, test, evaluate, and improve:

  • Computer-vision systems
  • Machine-learning systems
  • Artificial-intelligence systems
  • Spatial-understanding systems
  • Segmentation systems
  • Capture and tracking systems
  • 3D reconstruction systems
  • Automated processing and editing technology

This permission does not transfer ownership of your original User Content to XR Capsules.

XR Capsules will not use your User Content in public advertising or marketing materials in a manner that identifies you without your permission.

What Happens After Deletion

When you permanently delete User Content, XR Capsules will discontinue retention and new direct use of the stored copy and will delete it as described in our Privacy Policy.

However, you acknowledge that deletion does not require XR Capsules to reverse generalized software improvements, aggregate statistics, evaluation results, algorithmic improvements, or machine-learning model parameters created using the User Content before deletion, except where applicable law requires otherwise.

6. Your Responsibilities for Captured Content

You are responsible for the User Content you capture, upload, process, or share.

You represent and warrant that you have the rights, permissions, and legal authority necessary to provide User Content to Reality Studio and to grant the rights described in these Terms.

This includes obtaining permission where legally required before capturing or processing:

  • Private property
  • Homes and workplaces
  • Identifiable individuals
  • Copyrighted works
  • Confidential information
  • Personal documents
  • Restricted facilities
  • Other material belonging to third parties

You are responsible for complying with applicable privacy, surveillance, recording, intellectual-property, property-access, and other laws.

The availability of a Reality Studio feature does not mean that its use is lawful in every location or circumstance.

7. Generated Content and Accuracy

Reality Studio may produce models, geometry, splats, meshes, measurements, classifications, semantic information, or other generated results.

Generated results may contain errors.

Unless we expressly state otherwise, Reality Studio is not a surveying, engineering, architectural, safety-certification, medical, or other regulated professional tool.

You should not rely on generated measurements, geometry, classifications, or reconstructions where an inaccurate result could create a risk of injury, property damage, legal consequences, or significant financial loss.

8. Acceptable Use

You may not use Reality Studio to:

  • Violate applicable law
  • Infringe another person's intellectual-property or privacy rights
  • Capture or access property where you do not have permission
  • Upload content you are legally prohibited from possessing or processing
  • Exploit, harm, or endanger children
  • Distribute malware or malicious code
  • Attempt unauthorized access to accounts, systems, or infrastructure
  • Circumvent usage limits, security measures, or access controls
  • Interfere with the operation of the Services
  • Reverse engineer the Services except where applicable law expressly permits it
  • Use automated systems to overload or abuse the Services
  • Misrepresent generated material as authoritative where doing so could cause harm
  • Use the Services for fraudulent or deceptive activity

We may investigate suspected violations and suspend or terminate access where reasonably necessary.

9. Paid Services, Subscriptions, and Credits

Reality Studio may offer paid subscriptions, processing credits, or other paid features.

Prices, included features, billing intervals, and applicable taxes will be disclosed at the time of purchase.

If you purchase a recurring subscription, you authorize recurring charges according to the billing terms shown when you subscribe until the subscription is cancelled.

You may cancel recurring subscriptions using the cancellation method made available for that purchase.

Unless otherwise stated at the time of purchase or required by applicable law, payments are non-refundable after the applicable service or processing resources have been provided.

Credits:

  • Have no cash value
  • Cannot be redeemed for cash
  • May be used only for eligible Reality Studio services
  • Are non-transferable unless XR Capsules expressly permits otherwise

Purchases made through a third-party marketplace, including an application store, may also be subject to that marketplace's billing, cancellation, and refund policies.

Nothing in this section limits mandatory consumer rights.

10. Beta, Preview, and Experimental Features

Reality Studio is actively developed, and some features may be identified as beta, preview, experimental, or early access.

Such features may:

  • Change substantially
  • Produce unexpected results
  • Become temporarily unavailable
  • Contain bugs
  • Be discontinued

You should not rely on experimental functionality for critical applications unless we expressly state otherwise.

11. Availability and Processing

We aim to provide reliable service, but Reality Studio may occasionally be unavailable because of:

  • Maintenance
  • Infrastructure failures
  • Third-party outages
  • GPU or processing capacity
  • Network failures
  • Security incidents
  • Software defects
  • Events outside our reasonable control

We do not guarantee uninterrupted access or a specific processing time unless expressly stated in a separate written service agreement.

12. Third-Party Services

Reality Studio relies on or may integrate with third-party products and infrastructure.

Your use of third-party services may be subject to their own terms and privacy policies.

XR Capsules is not responsible for independent third-party services outside our reasonable control.

13. Intellectual Property

Reality Studio, excluding User Content, is owned by XR Capsules and its licensors and is protected by intellectual-property laws.

These Terms do not grant you ownership of Reality Studio's:

  • Source code
  • Software
  • User interfaces
  • Trademarks
  • Branding
  • Models
  • Algorithms
  • Processing technology
  • Documentation
  • Proprietary datasets or systems

Subject to these Terms, XR Capsules grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.

14. Feedback

If you voluntarily provide suggestions, ideas, feature requests, bug reports, or other feedback about Reality Studio, you grant XR Capsules the right to use that feedback without restriction or compensation to you.

This does not give XR Capsules ownership of unrelated User Content included in a support request.

15. Suspension and Termination

You may stop using Reality Studio at any time.

XR Capsules may suspend or terminate access if we reasonably believe:

  • You materially violated these Terms
  • Your use creates a security risk
  • Your activity is fraudulent or abusive
  • Your activity may expose XR Capsules or others to legal liability
  • Suspension or termination is legally required

Where reasonable, we will provide notice before terminating an account for reasons other than urgent security, fraud, abuse, or legal concerns.

Provisions that by their nature should survive termination will remain effective, including provisions concerning ownership, previously created generalized model improvements, disclaimers, limitation of liability, and disputes.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALITY STUDIO IS PROVIDED “AS IS” AND “AS AVAILABLE.”

XR CAPSULES DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICES WILL ALWAYS BE AVAILABLE
  • EVERY CAPTURE WILL PROCESS SUCCESSFULLY
  • GENERATED 3D CONTENT WILL BE COMPLETE OR ACCURATE
  • THE SERVICES WILL BE ERROR-FREE
  • ALL DEFECTS WILL BE CORRECTED
  • GENERATED RESULTS WILL BE SUITABLE FOR A PARTICULAR PROFESSIONAL PURPOSE

Some jurisdictions do not allow certain warranty exclusions, in which case those exclusions apply only to the maximum extent permitted by law.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XR CAPSULES AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, DATA, OR GOODWILL ARISING FROM OR RELATING TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XR CAPSULES' TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:

  1. THE AMOUNT YOU PAID XR CAPSULES FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
  2. US$100.

These limitations do not apply to liability that cannot legally be limited or excluded.

Mandatory consumer rights remain unaffected.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold XR Capsules harmless from third-party claims, damages, liabilities, and reasonable costs arising from:

  • User Content you provide
  • Your violation of another person's rights
  • Your unlawful use of the Services
  • Your material violation of these Terms

This section does not require indemnification to the extent a claim resulted from XR Capsules' own unlawful conduct.

19. Changes to the Services or Terms

We may modify Reality Studio and these Terms as the product evolves.

If we make a material change to these Terms, we will provide notice where required by law.

Your continued use of the Services after updated Terms become effective constitutes acceptance where permitted by applicable law.

If applicable law requires affirmative consent to a change, we will request it.

20. Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles.

Disputes that are not otherwise resolved will be brought before a court of competent jurisdiction in Washington State, except where applicable consumer law gives you the right to bring a claim elsewhere.

If you live in a jurisdiction that provides mandatory consumer protections, nothing in these Terms removes rights that cannot legally be waived.

21. Export and Sanctions Compliance

You may not use or export Reality Studio in violation of applicable United States export-control or sanctions laws.

You represent that you are not prohibited from receiving the Services under applicable law.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

23. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms expressly agreed between you and XR Capsules, constitute the agreement governing your use of Reality Studio.
